The 2022-2023 supplement includes a number of changes, such as:

  • A decision by the U.S. Court of Appeals for the Seventh Circuit determining whether the justices of the Wisconsin Supreme Court could claim judicial immunity when joined as defendants in a challenge to mandatory State Bar membership and compulsory dues
  • A 2021 opinion by the Seventh Circuit Court of Appeals deciding if an interlocutory appeal of a denial of qualified immunity was proper after a factual dispute prevented the resolution of a qualified immunity defense at the district court level
  • A Wisconsin Court of Appeals analysis of whether a Department of Revenue decision not to prosecute an offense was ministerial or discretionary
  • A 2022 decision by the U.S. District Court for the Eastern District of Wisconsin describing compliance with the notice-of-claims statute’s disallowance requirement

 

The 2020-2021 revision discusses a number of recent developments, such as the following: 

  • The Seventh Circuit Court of Appeals discussed the meaning of “clearly established” for purposes of qualified immunity in a 2019 opinion
  • In a 2019 opinion, the Wisconsin Supreme Court discussed pleading issues regarding the notice-of-claim statute
  • In a case involving a child’s drowning during a day camp activity, the Wisconsin Supreme Court analyzed the distinction between discretionary immunity and ministerial immunity
  • In a 2020 opinion, the Wisconsin Supreme Court discussed its analysis method for determining whether a person or an entity is an “agent” of the owner for purposes of applying the recreational immunity statute
