The 2021-2022 supplement includes a number of changes such as:
- Analyses of recent Wisconsin appellate court decisions on matters such as expert witnesses and discovery sanctions
- New discussions (and updates to sample forms) reflecting amendments to the Wisconsin Statutes that permit remote notarization of documents under certain circumstances
- Modifications to sample forms, with added space for the signing attorney’s email address (required for electronic-service procedures) and with updated annotations incorporating the Wisconsin Supreme Court’s amendment to the “ghostwriting” rule for limited-scope representation
- Additional citations to recent federal court decisions interpreting federal rules of procedure corresponding to Wisconsin’s discovery rules
The supplement also adds discussions of recent Wisconsin Supreme Court actions to extend the commercial docket pilot project and to allow court reporters to administer oaths and take testimony remotely. In addition, the supplement provides new discussions and practice tips concerning electronic discovery.
The 2019-20 supplement includes a number of changes such as:
- Extensive revisions to the Wisconsin Rules of Procedure that govern discovery procedures, including the creation of a new proportionality standard and limitations on depositions, interrogatories, and requests for production
- Reprinted sample forms, with updated annotations reflecting the legislature’s amendment to the disclosure requirements for attorneys in limited-scope-representation cases
- New discussions of recent Wisconsin Supreme Court cases on matters such as the standard for pleadings and factors to consider for admissibility of expert testimony
- Additional citations to recent federal court decisions interpreting federal rules of procedure corresponding to Wisconsin’s discovery rules
Wisconsin Discovery Law and Practice has been revised for 2017-18 to include key developments such as:
- A Wisconsin Supreme Court ruling on the circuit court’s authority to appoint and delegate pretrial responsibilities to a referee
- Guidance from federal courts on discovery-related matters, including:
- The time for giving notice of a deposition
- Sanctions for using “boilerplate” objections to discovery
- Requests for admission
- Production and preservation of electronically stored information (ESI)
- Expert testimony
- Updated forms to reflect the mandatory e-filing rule
- A new section on using experts in e-discovery disputes
- A new appendix containing resources for deposing an expert witness
References to The Sedona Principles: Best Practices, Recommendations & Principles for Addressing Electronic Document Production have also been updated to reflect the third edition, which was released in its final form at the end of 2017.
