The 2021–22 supplement includes a number of changes, such as:
- The required content of proposed parenting plans has changed, and parties who have been referred to mandatory mediation of custody and placement disputes must now submit proposed parenting plans before mediation
- The factors that a court must consider when awarding legal custody and placement have been revised
- The Wisconsin Statutes no longer authorize new awards of family support in divorce actions
- Wis. Admin. Code ch. DCF 150 has been retitled “Child Support Standard” and amended
- E-filing is now mandatory in the Wisconsin Court of Appeals, and portions of Wis. Stat. ch. 809, the rules of appellate procedure, have been amended to incorporate e-filing procedures
The 2020-2021 supplement includes a number of changes, such as the following:
- Pro bono, civil legal aid, and public defender attorneys can personally attest to their clients’ indigency by using the new attorney’s petition for waiver of fees and costs
- In a 2020 opinion, the U.S. Tax Court considered the interplay of an ex-spouse’s payments to his attorney and the basis of a limited liability company that the ex-spouse indirectly owned
- Two mandatory court forms, the Notice of Appeal and the Docketing Statement, have been updated
- In a 2020 published opinion, the Wisconsin Court of Appeals decided whether a statute of repose applied to bar a contempt motion seeking to enforce a pension division
All statutory and case-law references have been checked for updates, as have the mandatory and author-prepared forms.
The 2019-20 revision includes a number of changes, including the following:
- In 2019, the Wisconsin Supreme Court decided a case regarding the constitutionality of the grandparental visitation statute
- In 2020, the Wisconsin Supreme Court amended the so-called ghostwriting provision in the Wisconsin Statutes to remove the previous requirement that lawyers include their names and bar numbers when ghostwriting for otherwise self-represented people
- In some circumstances, conclusive determinations of paternity can be made based on genetic test results and thereby affect such things as custody orders
This revision reflects legal developments occurring since the publication of the second supplement to the ninth edition in 2019 and includes updated forms, as necessary, and updated statutory and case law references. Contribution limits for retirement plans have been updated, and recently revised versions of marital agreements appear.
