- The Wisconsin Legislature’s amendment of the Wisconsin Children’s Code to allow courts to order children into placements certified as qualified residential treatment programs (QRTPs)
- Recent Wisconsin appellate court opinions that discussed issues arising in cases involving orders for commitment, recommitment, or an extension of commitment under the Wisconsin Mental Health Act
- Revised discussions about techniques for conducting an interview with a child
- The Wisconsin Legislature’s creation of new training requirements for proposed guardians, beginning with petitions for guardianship filed on January 1, 2023
The 2020-21 supplement includes a number of changes such as:
- The Wisconsin Supreme Court’s expansion of continuing legal education requirements relating to the topic of family violence for attorneys who wish to serve as guardians ad litem for minors in family law cases (effective for appointment orders issued after January 1, 2021)
- The Wisconsin Legislature’s creation of a new children’s court procedure (in Wis. Stat. ch. 48) for guardianships of the person for children (effective August 1, 2020), replacing the probate court procedures previously applicable in such cases
- New legislation (effective August 1, 2020) relating to paternity determinations based on genetic test results
- Recent case law involving proceedings for recommitment and the involuntary administration of medication under the Wisconsin Mental Health Act
Certain sample forms have also been reformatted to provide spaces for email address information and to include a checkbox with new language for use in cases involving remote notarization.
