The 2022-2023 supplement includes a number of changes such as:
- The U.S. Court of Appeals for the Seventh Circuit and the Wisconsin Court of Appeals discussed misrepresentation by silence in recent opinions
- In a 2022 opinion, the Wisconsin Supreme Court determined the effect on a contract of one party’s making a handwritten change to a preprinted lien waiver
- In a published 2022 opinion, the Wisconsin Court of Appeals discussed the enforceability of anti-assignment provisions in insurance policies, and the Wisconsin Supreme Court has granted review
- The Wisconsin Supreme Court discussed conflicting contract clauses in a 2021 opinion
The 2020-21 supplement includes a number of developments, including the following:
- In 2019, the Wisconsin Supreme Court discussed the circumstances in which Wisconsin courts treat heirs as third-party beneficiaries of the attorney-client contract
- In a 2020 opinion, the Wisconsin Court of Appeals determined whether a promise to form a contract was illusory
- The Wisconsin Court of Appeals, in a 2020 opinion, discussed rights of parties when contracts are determined to be unenforceable
- One of Wisconsin’s federal district courts determined the effect—in a dispute between a purchaser of real property and a creditor—of another person’s failure to sign the sales contract for the real property
All case-law, statutory, and administrative code citations have been updated.
The 2018-19 revision incorporates many changes, including the following significant developments:
- In a 2017 opinion, the Wisconsin Supreme Court discussed enforcement of a contractual jury-waiver provision
- The U.S. Supreme Court issued an opinion in 2018 regarding the enforceability of arbitration agreements that waive the right to pursue class and collective actions
- In a 2017 opinion, the Seventh Circuit Court of Appeals discussed whether following the “letter but not the spirit” of an agreement was a breach of contract
- The Wisconsin Court of Appeals issued a published decision in 2017 regarding whether the absence of a spouse’s signature on a mortgage was a “mistake” and whether the mortgage could be reformed
A new section in chapter 7 discusses modification of trust agreements, and a new section on effect of full performance has been added to chapter 10.
