Product ID: CA3576D
Presented By: State Bar of Wisconsin PINNACLE

This program is an excerpt from the Annual Bankruptcy Update – Eastern and Western Districts 2022.

It’s personal

Filing for bankruptcy can be an intimidating, emotionally taxing experience for your clients. When a personal injury claim is intertwined with a bankruptcy, the case can be particularly daunting. For clients with a pending or current personal injury claim, it’s important to understand how a bankruptcy could influence the outcome.

At Personal Injury Claims in Bankruptcy, Nicole I. Pellerin and Zeshan Usman will provide answers to questions such as:

  • What are the duties of the bankruptcy lawyer and the personal injury lawyer?
  • What happens to a personal injury claim if the claimant files for bankruptcy?
  • Which claim should be filed first?
  • What happens if the client fails to disclose a personal injury cause of action to the bankruptcy court?
  • What if the personal injury claim accrues after the bankruptcy?

Nicole I. Pellerin is a shareholder with Murphy Desmond, S.C. in Madison and focuses her practice in bankruptcy and insolvency, including representing individual and business debtors and creditors in all chapters of bankruptcy and creditors committees in Chapter 11 cases. She also represents Chapter 7 panel trustees and receivers in state court receiverships and serves as a Chapter 7 panel trustee in the Western District of Wisconsin and the Northern District of Illinois.

Zeshan Usman grew up watching his immigrant father’s hard work propel him from dishwasher to successful business owner. His father’s entrepreneurial spirit rubbed off on him. While still attending to his formal education, Zeshan started Usman Realty and worked as a licensed real estate broker, mortgage broker, and general contractor. In 2007, as the Great Recession loomed, Zeshan received a J.D., M.B.A. from the University of Miami. During a burst in the housing bubble, he took what he learned working in real estate and transitioned his focus from Usman Realty to Usman Law. Since starting Usman Law fifteen years ago, Zeshan has helped thousands of people straighten out their finances and fight back against abusive debt collectors and unreasonable insurance claim adjusters. His practice is limited to personal injury and debt relief.
