Moore v. Harper has been called “the 800-pound gorilla” of election law.  At issue in Moore is whether the North Carolina Supreme Court has the authority to strike down a congressional map drawn by the state’s legislature. Central to the case is the “independent state legislature theory.” 

Proponents of this theory argue that the Elections Clause of Article I of the U.S. Constitution gives state legislatures the power to regulate federal elections and that power exempts election regulations from state judicial review. Opponents argue that sanctioning the independent state legislature theory would destabilize election administration and erode state-based voting rights. And now that the North Carolina Supreme Court has reversed its earlier decision in the underlying redistricting dispute, the U.S. Supreme Court may decline to rule on Moore, leaving the fate of the ISLT in question.

Ann S. Jacobs is the founder of Jacobs Injury Law, S.C. Her practice includes automobile accidents, nursing home abuse, and neglect cases, financial abuse/fraud, as well as medical malpractice cases. She is a 1992 cum laude graduate of University of Wisconsin Law School, where she was a member and coach of the Intellectual Property Moot Court Team. She completed her undergraduate at the University of Wisconsin with distinction, winning the Leon Epstein Award for Outstanding Student in American Government. Ms. Jacobs began her legal career as a public defender, litigating dozens of jury trials over nearly a decade, from juvenile cases to homicides. She honed her trial skills during that period and championed cases for her clients. During that time, she was one of the original authors of the Wisconsin Juvenile Law Handbook, published by the State Bar of Wisconsin, writing the original chapter on the Uniform Child Custody Jurisdiction Act. Ms. Jacobs left the public defender's office and began her career as a trial attorney in private practice, advocating for the rights of the injured. Since then, she has represented hundreds of clients in a wide variety of cases, winning outstanding results for them, including at trial. 

Don M. Millis is a shareholder in the Madison office of Reinhart Boerner Van Deuren, s.c.  He has an undergraduate degree from UW-Madison (Political Science/Journalism) and a law degree from the University of Wisconsin Law School (Order of the Coif).  Mr. Millis is a past member and chair of the Wisconsin Tax Appeals Commission and of the State of Wisconsin Elections Board. He currently chairs the Wisconsin Elections Commission.  Mr. Millis’ practice concentrates on state and local tax litigation and speaks frequently on these subjects. He is a   member of the State Bar of Wisconsin and the Dane County Bar Association as well as the Institute for Professionals in Taxation. Mr. Millis is also President and CEO of WE International, Inc., a Madison-based nongovernmental organization working in East Africa that operates a home for women who have been trafficked, provides microfinance loans primarily to women entrepreneurs and scholarships for children whose families cannot afford school tuition.
