8:30 am Ethical Considerations with the Attorney-Client Relationship
- Lawyers spend many hours interviewing potential clients and need to obtain important information that may affect the opportunity for the lawyer to represent the client. The panel will discuss conflicts of interest with prospective clients and how to avoid obtaining relevant information that precludes representation by the lawyer or law firm with the opposing party.
- Lawyers participate in ListServs to gain insights for the representation of clients. Ethical traps may arise from the use of ListServs under certain conditions.
- Lawyers often use recording systems to help retain information when talking with clients and others. Significant questions arise as to the ethical appropriateness of this conduct. Lawyers will learn the guidelines for using recordings during representation.
- Lawyers are called upon to prepare clients or other witnesses for contested proceedings. There are limits to what a lawyer can do when prepping a witness. Lawyers will learn the extent to which they may assist their clients in preparing for a contested proceeding.
