Preserving Digital Evidence: Practical Tips to Manage a Litigation Hold and Avoid Spoliation 2022

Product ID: CA3333R8
Presented By: State Bar of Wisconsin PINNACLE

Remote control

The hybrid and remote work revolution has led to increased use of home computers, as well as an uptick in the use of collaborative communication platforms like Microsoft Teams, Zoom, and Slack. Remote work and new technology aren’t going away. Neither are litigation holds, which are designed to preserve information in the face of potential litigation or investigations. But preserving data on home devices and multiple electronic platforms is a newer challenge.

If, during a litigation hold, an employee deletes, misplaces, or alters the wrong file or saves it to a place their employer doesn’t have access to, the employer could face sanctions for spoliation. That’s why Preserving Digital Evidence: Practical Tips to Manage a Litigation Hold and Avoid Spoliation is here to help.

At this timely program, you will:

  • Review the basics of e-discovery and electronically stored information (ESI)
  • Uncover potential sources of data and their functions
  • Examine how the unique characteristics of data sources impact preservation, collection, and search strategies
  • Analyze issues related to the negotiation of ESI protocols and proportionality
