Product ID: CA3721W
Presented By: State Bar of Wisconsin PINNACLE

Easement does it

A client discovers one of their neighbors is using a portion of their land as a driveway without permission. The neighbor says they’ve used the driveway daily for years, claiming they have an easement to use that part of the property. The client consults you, hoping you can help them understand their rights, assess the validity of the neighbor’s claim, and determine whether legal action should be taken to resolve the dispute. Preparing an easement case can be challenging for the uninitiated. Will you be ready?

At Handling Your First Easement, seasoned property lawyer Jessica A. Shrestha will guide you through the nature, creation, and enforcement of easements. You’ll learn the specific types of easements, including access, riparian rights, utility, and public highway easements. Get comfortable with easement terminology and basic concepts such as:

  • The benefits and burdens
  • How easements are formed
  • Easements appurtenant versus in gross
