A PFAS reporting primer
In fall of 2023, the U.S. Environmental Protection Agency (EPA) released its long-awaited rule requiring manufacturers to report per- and polyfluoroalkyl substances (PFAS). The new rule will provide the EPA with the largest-ever dataset of PFAS used and manufactured in the U.S.1 Given the risk of penalties for noncompliance, attorneys should understand the rule and how to effectively counsel clients on gathering the required information in order to meet the EPA’s deadlines.
