This case, in which liability and damages will be tried to a live jury, involves a number of unique facts and issues. While hauling a heavy trailer, the defendant’s pickup truck struck the rear of a semi-truck cab driven by the plaintiff, who claims he can no longer perform his over-the-road truck-driving job due to injuries to his lower back. Defendant claims his view was blocked by two cars traveling in front of him, and when the SUV in front of defendant pulled left out of the curb lane, the stopped semi cab was right in front of the defendant. Issues to be tried include the defendant’s negligent control of his vehicle — and in particular — failure to maintain a safe following distance. Witnesses include the plaintiff, defendant, responding police officer, vocational experts, treating neurosurgeon, and IME neurosurgeon.

The Wisconsin ABOTA Chapter is sanctioned by the American Board of Trial Advocates, and is committed to improving the quality of legal representation, promoting the art of advocacy, and efficiently administrating justice. To qualify as a member, attorneys must be nominated by another member, achieve at least six years of active experience as a trial lawyer, and have tried at least 25 jury trials to conclusion over the course of their careers.
