  • What is the applicable interest rate on debts reduced to judgments pre-bankruptcy?
    o Contract rate, judgment rate, or statutory rate?o Understand the gaps in coverage
    o If the contract rate applies, what is the legal authority for a court to set a different interest rate in a judgment than the statutory rate established by Wis. Stat. §814.04(4)
    o If statutory, will the creditor be adequately protected in a reorganization proceeding if the contract or Till rate would be higher
  • What is the proper method of calculating interest under §506(b)?
    o What is the interest rate if the underlying contract is silent?
    o Does statutory construction separate the “agreement” from the calculation of interest on the claim, requiring a different determination of the rate? If so, how is interest determined?
