ABOTA 2016 Case Synopsis

An elderly woman experienced a fall during her stay at a nursing home as she recovered from hip surgery. As ordered by her therapists, she moved from the dining hall to her room using a walker while a CNA followed with a wheelchair in case she became weak or fatigued. When she arrived back at her room and went to sit down, she fell to the ground and broke her other hip and her pelvis. Our jury will decide whether the CNA was negligent in not having the wheelchair ready or if the patient tripped and fell independently. Testimony will be heard from the plaintiff, the aid, a Spanish-speaking witness, the director of nursing, and liability experts.
