  • In a 2022 decision, the Labor and Industry Review Commission (LIRC) considered whether day-to-day stressful events can accumulate to such an extent as to become unusual and result in a compensable mental injury
  • In two 2022 decisions, LIRC considered claimants’ due process rights
  • In a published 2023 opinion, the Wisconsin Court of Appeals considered whether the independent-contractor rule should be applied to bar a subcontractor’s employee from bringing a third-party tort claim against the general contractor
  • In a 2023 opinion, the Wisconsin Supreme Court considered the interaction of underinsured motorist limits in automobile insurance policies and amounts paid and received in worker’s compensation cases

 

 

The supplement reprints the most current versions of many Department of Workforce Development worker’s compensation forms.

The 2022-2023 revision includes a number of changes such as:

  • LIRC and the Wisconsin Court of Appeals determination on whether an individual who engaged in demolition work was an independent contractor or an employee
  • The Wisconsin Legislature’s repeal and recreation of a statutory provision that deals with calculating average weekly wages for part-time employees
  • A discussion of a change in procedure regarding assignment of administrative law judges
  • The U.S. District Court for the Eastern District of Wisconsin consideration of whether an employee’s tort claim for intentional infliction of emotional distress was barred by the exclusive-remedy provision of Wisconsin’s worker’s compensation law
