The 2018-2019 supplement discusses a number of important legal developments, including:

  • A U.S. Supreme Court decision regarding consequences of the government’s failure to honor a plea agreement
  • A Wisconsin Supreme Court ruling on if a defendant can seek expungement after a sentence is imposed
  • New e-filing rules governing service of court records and transcripts postconviction
  • Proper analysis when a court fails to advise a defendant of potential immigration consequences of a plea

The 2016-17 supplement of the Wisconsin Criminal Defense Manual reflects important recent legal developments, including:

  • New electronic filing (e-filing) requirements being phased in on a county-by-county basis. Author-drafted forms and references to mandatory court forms have been updated to reflect these new rules.
  • For a charge of operating a motor vehicle while intoxicated, fourth offense, courts have a longer time period to look for prior convictions.
  • Wisconsin Supreme Court opinions discussing:
    • The use of an expert witness who reviewed the file of a lab analyst, who was employed in the same lab but unavailable for trial.
    • Ex post facto claims for clients, who committed crimes, were sentenced, or were serving sentences while 2009 Wis. Act 28 was active.
    • The need for attorneys to discuss the potential for deportation if a client is not a citizen.
    • Whether a trial court should have dismissed a criminal complaint because it was not sufficiently definite.
