Newly revised for 2023
The 2022-2023 supplement includes a number of changes such as:
- In opinions issued in 2020, the U.S. District Court for the Eastern District of Wisconsin considered whether a meeting template was a trade secret and whether a list of former clients was a protected trade secret
- The Wisconsin Supreme Court has extended the Commercial Docket Pilot Project
- State and federal courts issued decisions in 2021 and 2022 in which they discussed whether parties to contracts had agreed to arbitration provisions in the contracts
- In a 2022 published opinion, the Wisconsin Court of Appeals discussed ways in which an arbitrator might jeopardize the legitimacy of an award

The 2020-2021 supplement includes a number of changes, such as the following:
- In a 2020 decision, the Wisconsin Supreme Court discussed the relative importance of identity of ownership when courts are considering exceptions to the general rule of successor nonliability
- A 2019 Wisconsin Supreme Court decision considered whether a circuit court’s order denying a request to compel arbitration is immediately appealable
- In 2019, the Wisconsin Court of Appeals decided that fundamental contract principles govern enforceability of mediation settlement agreements
In addition, a new section summarizes the Commercial Docket Pilot Project, whose creation the Wisconsin Supreme Court approved in 2017.
Newly revised for 2019
The newly expanded 2019 edition includes two new chapters on commercial dispute resolution: Chapter 5, “Arbitration in a Business Setting,” and Chapter 6, “Mediation a Business Setting.” Because in an environment when fewer cases reach the courtroom, it’s essential for business litigators to master other forms of dispute resolution, such as arbitration and mediation. Attorney Terry F. Peppard revised and adapted these chapters from another State Bar publication, Arbitration and Mediation of Business Disputes: A Wisconsin Practitioner’s Guide.
Other changes in the 2019 edition include:
- Clarification of the breadth of the “fraud in the inducement” exception to the economic loss doctrine
- Recent decisions on whether bids, strategic plans, customer data, and pricing information might be protected trade secrets
- Wisconsin Supreme Court consideration of whether the Wisconsin Uniform Fraudulent Transfers Act, Wis. Stat. ch. 242, supplants the common-law fraudulent transfer exception to the rule of successor nonliability
- A new anti-“piling on” provision relating to imposition of penalties on corporate defendants
