The 2023-2024 supplement includes a number of changes such as:
- Wisconsin state and federal courts’ analysis of arbitration provisions to decide, for example, whether an arbitrator exceeded the arbitrator’s powers, whether third parties could enforce arbitration clauses, whether arbitration clauses applied to third parties, or whether a party forfeited an objection to a sleeping arbitrator
- A Wisconsin Court of Appeals case considering whether the doctrine of equitable estoppel applied to a lease in a landlord-tenant dispute
- Chapter 3 replacing sections about contractual modification and limitation of remedies and including a new section about mitigation of damages
- The Wisconsin Supreme Court’s review of cases concerning statutory claims of unconscionability and whether Wis. Stat. § 100.18(1) applies to representations made to non-Wisconsin residents
Chapters 1 and 3 are reprinted in their entirety to incorporate several discussions of recent cases.
The 2021-2022 revision includes a number of changes, such as the following:
- The federal and state courts in Wisconsin decided several cases concerning the economic loss doctrine and its exceptions.
- The U.S. District Court for the Western District of Wisconsin enumerated the factors that a court considers when determining whether to compel arbitration.
- Two opinions from the U.S. District Court for the Eastern District of Wisconsin concerning whether Wis. Stat. § 100.18 grants out-of-state residents standing to sue under the law had divergent outcomes.
- A new section provides an introduction to and discussion of electronic transactions, including cases and statutes regarding debit cards, credit cards, ACH transfers, and Article 4A of the UCC.
- A new section discusses privacy and publicity rights and the internet.
