The 2023-2024 supplement includes a number of changes such as:

  • Federal law protections and rights for pregnant or breastfeeding workers have been increased
  • In a 2023 published opinion, the Wisconsin Court of Appeals analyzed whether an organization’s sub-entities were “operated primarily for religious purposes”
  • The SECURE 2.0 Act of 2022 made significant changes to the tax code provisions regarding retirement plans
  • Several statutes in Wis. Stat. ch. 181 were amended or repealed and recreated by 2021 Wis. Act 258. Relevant changes have been made to chapter 9, Merger, Conversion, Sale of Assets, and Dissolution, which has been reprinted in full as part of this supplement 

 

 

The 2020–2021 supplement includes a number of changes, such as the following:

  • Simplified rules implemented by Congress relating to the private-foundation excise tax on net investment income
  • A discussion of the U.S. Supreme Court’s groundbreaking decision in Bostock v. Clayton County, Georgia, regarding termination of employees because of sexual orientation
  • The increased salary levels for the “white-collar” and “highly compensated” exemptions to the Fair Labor Standards Act (FLSA) overtime-pay requirements
  • Congress’s significant changes to the tax code provisions regarding retirement plans that are tax qualified under I.R.C. § 401(a)

In addition, temporary legislative changes made in response to the COVID-19 pandemic are discussed where appropriate.

Now updated as a 4th edition, the Guide reflects a variety of key legal developments, including:

  • Changes made by the 2017 federal tax reform law such as:
    • A reduction of the corporate income tax rate which applies to unrelated business taxable income (UBTI)
    • UTBI increases based on payments made or amounts incurred for certain fringe benefits
    • New excise taxes on certain college/university endowments and “excess” compensation
  • New author commentary on workplace sexual harassment policies
  • The current legal status of overtime pay regulations
  • Repeal and replacement of Wis. Stat. ch. 11, Campaign Financing

All case law, statutory, and regulatory citations have been updated. Each chapter has also been revised to incorporate materials from previous supplements.
