Termination of Parental Rights 2023

Compassionate counsel

Before a child can be adopted in Wisconsin, the parents of the child must voluntarily relinquish their rights or have them terminated involuntarily. Termination of parental rights (TPR) proceedings require compassionate legal counsel with a detailed understanding of the statutory requirements and procedures involved.

Termination of Parental Rights is a unique opportunity to gain insight into the TPR process from a corporation counsel who has represented the interests of the state and from attorneys who have represented parents in voluntary and involuntary termination proceedings. They’ll use their experience to explain the TPR process from start to finish, providing helpful guidance on:

  • Voluntary vs. involuntary grounds for termination
  • The burden of proof in involuntary terminations
  • How representation of the parties is determined
  • Considerations under the federal Indian Child Welfare Act
  • The bifurcated hearing process
  • Notice requirements
  • The rights of the parent(s) to counsel and participation
