Conflicts in Joint Representation 2026

One lawyer, two clients, no surprises

Joint representation of parties in a matter can be tricky to navigate, but there are circumstances in which it is the right choice. Conflicts in Joint Representation focuses on the conflicts that arise during joint representation, determining whether those conflicts are waivable, and drafting a sufficient conflict waiver. You will work through Supreme Court Rule (SCR) 20:1.7(a) and (b) and the definitions that govern what a valid waiver must contain.
