As times have changed, so have families. In 1970, 70% of the U.S. population was married. In 2017 that number fell to 48%. Along with the steady decline of marriage numbers, more people are cohabitating without marriage – a number that has increased by 29% from 2007 to 2016.

At the same time, LGBTQ couples are embracing marriage. More than 60% of cohabitating same-sex couples are married. And rates of step-parent and second-parent adoption and surrogacy are also on the rise. The “traditional” family of a mom, dad, two biological kids, and a dog is no longer the rule or the majority.

The 2021–2022 revision includes a number of changes, such as the following:

  • In a 2020 opinion, the U.S. Court of Appeals for the Seventh Circuit considered the treatment of same-sex and different-sex spouses in matters of their children’s legal parentage and birth certificates
  • Discussions of recent cases in federal courts involving birthright citizenship of children born abroad through assisted reproductive technology
  • Individuals who want to avoid probate might consider using transfer-on-death designations for certain assets
  • In a 2019 opinion, the Wisconsin Supreme Court provided guidance on the legal burden necessary to overcome a fit parent’s wishes regarding a third party’s visitation with a child
