Circuit Court Commissioner
PURPOSE AND SUMMARY <br />The Circuit Court Commissioner is appointed by the Circuit Court Judges to assist in the administration of the court system by assuming some of their duties. This is usually done in one of three ways. The first is to conduct preliminary matters in certain court proceedings, including temporary order hearings in divorces; probable cause hearings in mental commitments; and bail hearings and/or initial appearances in criminal, traffic, ordinance, paternity and juvenile court cases. The Court Commissioner is also on-call 24 hours a day to authorize search warrants in criminal investigations. <br /><br />Second, in addition to preliminary matters, the Court Commissioner renders final decisions in stipulated divorces, domestic abuse and harassment injunction hearings. <br /><br />Third the Court Commissioner acts as both Department Head and Director of Family Court Services, overseeing both the family court mediation and parent education programs. <br /><br />ESSENTIAL DUTIES <br />• Supervise staff of Court Commissioner’s Office (2 Paralegal Aides and the Assistant Court Commissioner). <br />• Supervise family court mediators. <br />• Contract with mediators and administer family court mediation program. <br />• Supervise instructors and administer parent education program. <br />• Preside over felony and misdemeanor bail hearings. <br />• Preside over initial appearances in juvenile and child protection matters. <br />• Preside over paternity hearings. <br />• Preside over mental commitment and guardianship proceedings. <br />• Preside over initial appearances in traffic and ordinance matters. <br />• Preside over stipulated divorces. <br />• Conduct temporary order hearings in family cases. <br />• Appoint Guardians ad Litem as needed in family cases. <br />• Issue initial orders of protection in domestic violence and harassment matters. <br />• Preside over final hearings and the issue permanent injunctions in domestic violence and harassment restraining order requests. <br />• Perform weddings. <br />• Assist Assistant Court Commissioner in the performance of her duties as needed. <br />• Prepare department budget and report to County Administrator, Law Committee and County Board. <br />• Consult with legal offices, organizations and parties involved in litigation to obtain necessary information regarding individual cases. <br />• Work closely with Circuit Court Judges to maintain continuity of services for the public. <br />• Attend monthly Judges’ Meetings and serve on sub-committees as needed. <br />• Work closely with Clerk of Courts personnel in maintaining court calendar and responding to correspondence and inquiries from the public, attorneys and law enforcement personnel. <br />• Make independent decisions as the situation may dictate within the scope of the Circuit Court Commissioner’s statutorily authorized duties. <br />• Communicate with individuals of various cultures, with the assistance of interpreters as needed. <br />• Explain complex court procedures and processes to the public. <br />• Perform duties in a calm, objective and unbiased manner. <br /><br />QUALIFICATIONS <br />Graduation from an ABA-recognized law school. Pursuant to Wis. Stat. SCR Rule 75.02, circuit court judges may appoint only persons who are licensed to practice law in Wisconsin, are in good standing with the Supreme Court, and who have been licensed to practice law in any state for three years immediately before the appointment. <br /><br />Must have extensive knowledge of criminal, civil and family law. Able to work accurately and quickly under tight deadlines. Proven ability to work with individuals of different cultures and interpreters who may need to assist litigants. Knowledge of the practices, ethics, and procedures of the legal profession required. Must be able to communicate effectively orally and in writing.
